Media Terms of Use
When hiring a professional photographer or videographer, the client pays a licensing fee which grants the client permission to use the work. The licensing fee is often built into the total price and can vary based on a number of factors. Such factors can include but are not limited to exclusivity type, whether or not the license is transferable, the length of time the work is to be used, the size of the company using the work, how the work is to be used (personal versus commercial) and more. These are known as “Usage Rights”. Another common example of this can be found in the music industry. A user can purchase a Taylor Swift song from iTunes, but they aren’t purchasing the actual song. They are purchasing a license to use the song and the usage rights of that license are for “Personal Use” only, which is why the cost is roughly only about $1. If the National Football League would like to purchase a license from Taylor to use that exact same song, but will be using it to advertise in all their stadiums during all of their football games, the usage rights as well as the cost to that license would be much different.
At Absolute Altitude Llc., we take the licensing of our work very seriously. Creating and licensing content that helps our clients sell their product, service or commodity is our livelihood. When one of our clients purchases a media package from us, they are also purchasing a non-transferable license that governs the use of that media. This media cannot be given or sold to another person or entity without the express written consent of Absolute Altitude Llc.
Absolute Altitude Llc. retains ownership and copyright of the work and rights to use and sell the work indefinitely, in all forms, including and not limited to Absolute Altitude Llc.’s own use for any personal or commercial portfolio, advertising, marketing, display and for resale in both print and digital media.
Any digital work produced by Absolute Altitude Llc. may not be given or transferred to another real estate agent, brokerage, homeowner, stager, designer, builder, or other third party including instances where a listing is lost or transferred between agents or brokerages. A new user taking over a listing with media produced by Absolute Altitude Llc. is required to purchase a new license if they would like to reuse the media for that listing.
For real estate, short-term and long-term rentals, the owner of the property releases all rights to the location by agreeing to have the property photographed.
Resale License: Clients that purchase a license to use media produced by Absolute Altitude Llc. for the resale of a property will have usage rights that allow indefinite commercial use of the brand and likeness of the person as well. This is an added benefit, which contains significant value to our clients. The usage of this license still remains non-exclusive and non-transferable. It may not be used to promote or sell a third party. It may not be used to resell the same property if it is sold and comes up for sale again.
Short & Long-Term Rental License: Clients that purchase a license to use media produced by Absolute Altitude Llc. for the short or long-term rental of a property will have usage rights that allow for commercial use of that property for an indefinite period of time. The person or entity that purchases the license may also use the media to commercially promote their brand or likeness. This is an added benefit, which contains significant value to our clients. The usage of this license still remains non-exclusive and non-transferable. It also may not be used to promote or sell to a third party.
Commercial-Use License: Clients that purchase a license to use media produced by Absolute Altitude Llc. For the purposes of promoting and marketing their business will have usage rights that allow for commercial use of that property for an indefinite period of time. The person or entity that purchases the license may also use the media to commercially promote their brand or likeness. This is an added benefit, which contains significant value to our clients. The usage of this license still remains non-exclusive and non-transferable. It also may not be used to promote or sell to a third party.
